The Office of Long Term Care administers the Long-Term Care
Criminal Record Check program.
This program requires certain long-term care
employees to undergo criminal record checks prior to
employment in a long-term care facility.
Conviction of certain specified crimes will result
in an applicant being permanently barred from working in a
long-term care facility.
Other, lesser crimes can result in suspension from
employment in a long-term care facility for ten (10)
years. The
Office maintains a database, or registry, of individuals
who are excluded from employment.

The Office of Long Term Care’s CNA program provides guidelines
for the training and testing of individuals who wish to be
certified as CNA's.
In addition, the Office maintains a database, or
registry, of current CNA's, as well as those against whom
a finding of resident abuse or neglect, or
misappropriation of resident property has been made.

The Office of Long Term Care will, at the request of the
public, provide speakers to offer additional information
on the duties and authority of the Office.

Involuntary discharge appeals

When a resident of a long-term care facility feels that he or
she is being unfairly or illegally discharged from the
facility, he or she can utilize the Involuntary Discharge
Appeal process maintained by the Office to challenge the
discharge.
Appeals are heard by neutral, unbiased attorneys with whom
the Office contracts.

The Office of Long Term Care
provides for the testing and licensing of nursing home
administrators, and the approval of continuing training.
This ensures that individuals must meet minimum
standards of knowledge before they can act as facility
administrators.

The Office of
Long Term Care conducts investigations of complaints in
which abuse or neglect of residents, or misappropriation
of resident property, is witnessed, suspected, or alleged
in long-term care facilities.
Complainant information is kept confidential.
If violations of laws or regulations are found, the
Office of Long Term Care can impose fines or other
sanctions against the facility, and can exclude the
perpetrator from employment in long-term care facilities.
Any person can make a complaint, and may do so
anonymously. In addition, complaints can be made by mail
or email.
Also, the Office conducts periodic, unannounced surveys of
all facilities in Arkansas to ensure that the facilities
adhere to minimum requirements for both resident care and
physical conditions.
The Office can impose fines, revoke licenses, or
take other action to ensure compliance.

The Office
of Long Term Care licenses long term care facilities and
is authorized by law to seek court orders prohibiting
facilities from acting as long-term care facilities when
the facility is not licensed.
This acts to ensure that facilities that hold
themselves out as long-term care facilities meet specified
minimum standards.
